Terms of Service

1. Acceptance of Terms

By accessing or using the CalorieTracker mobile application (the “App”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the App.

2. General Information Only – Not Medical Advice

All information provided by CalorieTracker, including calorie estimates, macronutrient breakdowns, health scores, and related nutritional data (collectively, the “Content”), is generated using artificial intelligence and is intended solely for general informational and educational purposes.

The Content does not constitute medical advice, diagnosis, or treatment. CalorieTracker is not a substitute for professional medical guidance, dietary planning, or nutritional counseling. You should consult a qualified healthcare provider before making any health-related decisions based on information from the App.

3. No Warranties on Accuracy

Due to the nature of AI and food recognition, all estimates provided (including calorie and macronutrient data) are approximations only and may contain errors or omissions. The App does not guarantee the accuracy, completeness, or reliability of any nutritional data or scores.

You acknowledge and accept that results may be inaccurate, inconsistent, or vary significantly depending on input quality (e.g., image clarity, portion size, labeling).

4. Health Use Restrictions

CalorieTracker is not intended for use by individuals with medical conditions, including but not limited to diabetes, eating disorders, food allergies, or other health conditions requiring precise dietary tracking.

By using the App, you represent that you:

• Are over 18 years old or If you are under the age of 18, you must use CalorieTracker only with the permission and supervision of a parent or legal guardian. By using the app, you represent that you (or your parent/guardian) have read and agreed to these Terms of Service.;
• Are not using the App as a substitute for medically necessary tools or professional dietary oversight;
• Understand and accept the limitations of the AI-generated data.

5. Limitation of Liability

To the maximum extent permitted by law, CalorieTracker, its developers, officers, affiliates, licensors, and service providers shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to:

• Injury or illness related to reliance on inaccurate data;
• Health complications from following information provided by the App;
• Loss of data, profit, or business interruption.

Use of the App is at your own risk. The App is provided “as is” and “as available,” with no warranties of any kind, express or implied.

6. User Responsibility

You are solely responsible for any decisions or actions you take based on information obtained from the App. You agree not to use CalorieTracker in any way that:

• Violates applicable laws or regulations;
• Substitutes for professional advice;
• Encourages harmful or disordered eating behaviors.

7. No Liability for Third Parties

CalorieTracker may reference, link to, or integrate third-party tools, APIs (including OpenAI GPT APIs), or services. We do not control or guarantee the reliability of any third-party information, and we are not liable for their content or services.

8. Changes to the App or Terms

We reserve the right to modify or discontinue the App (or any part of it) at any time without notice. We may also update these Terms from time to time. Continued use of the App after changes constitutes your acceptance of the revised Terms.

9. Indemnification

You agree to indemnify and hold harmless CalorieTracker, its creators, and affiliates from any claims, losses, liabilities, damages, or expenses (including legal fees) arising from your use or misuse of the App, or your violation of these Terms.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States and the State of California. You agree that any dispute related to these Terms or your use of the App will be resolved exclusively in the courts located in California, and you waive any right to a jury trial or class action.
